1. When do I need a fence permit?

The property owner is required to get a fence permit when erecting a new fence or replacing a fence prior to construction. Fence permits are issued through the Planning Division. Be prepared to provide setbacks and the size and location of the new fence to the Planning Division for fences of 6 feet or less in height. Fences taller than 6 feet are allowed in residential zoning if the fence is located at the required building setback for the district. Fences over 6 feet will require a building permit from the Building Division.

2. Do I need a building permit to put new siding, renovate, or put a new roof on my house or building?

Yes, prior to construction. The home owner is responsible for getting the building permit or making sure the contractor gets the building permit or the construction may be stopped until the permit is obtained. Note there are higher fees for starting construction before obtaining the building permit.

3. How may I get information from multiple city departments while I am in the planning process for a commercial structure?

You may set up a concept review meeting through the Building Division prior to submitting for the building permit. Generally, members from the building, engineering, planning, public works, environmental, engineering, and fire departments will attend to provide feedback on the submitted concept plan.

4. Do commercial buildings require professional site plans?

Yes, your site plans must be prepared by a licensed architect with structural and civil engineers input.

5. I have completed my commercial building, but I am not sure I will finish the landscaping before winter starts. Will I be eligible for a Certificate of Occupancy?

Before a certificate of occupancy is issued the commercial building must have the landscaping complete or a bond for 150% of the remaining landscaping construction must be received by the Commercial Code Enforcement Officer.

6. Where may I find the zoning for my property?

You may find it if you know the address at the Yellowstone County Treasurer’s Tax Search page at http://www.co.yellowstone.mt.gov/gis/index.asp . The zoning is at the bottom of the Property Tax Information page under Jurisdictional Information.

7. I am thinking of building a multifamily structure on my property, what would be required?

First, ensure your property has the correct zoning for a multifamily development. If your development includes multiple buildings a Master Site Plan may need to be submitted and approved through the Planning Division. If you have a concept plan, contact the Building Division to set up a concept review meeting.
